Chapter 13 Success Rates

For 2011, the US Bankruptcy Court has released their statistic for Chapter 13 Plan completion. According to their statistics, for the State of Hawaii year ending December 31, 2011, there were a total of 327 chapter 13 cases closed (this means completed or dismissed or hardship discharged).

Of those 327 cases:

  • 90 cases fully completed their plan
  • 19 of the completed cases required modifications during the plan
  • 327 of the cases were dismissed for any reason. (this number does seem high. It may include conversions to chapter 7)
  • 84 of the dismissals were for failure to make plan payments
  • So if you are a chapter 13 debtor, make sure to make your plan payments. If you can’t make your payments, talk to your attorney about modifying your plan or doing a hardship discharge or converting to chapter 7 or possibly refiling.
