Most everyone knows that student loans are generally not discharged in bankruptcy, but that doesn’t mean that bankruptcy can’t be used to help you with a student loan problem.
First, it is possible to discharge student loans, but it is difficult. To see what it takes to discharge a student loan in Hawaii, look at this opinion from the Hawaii bankruptcy judge. As you can see, it takes quite a bit to get a discharge of student loans.
A bankruptcy can help with large student loan debt by freeing up money paid to other creditors, so you can pay towards the student loans. A person would typically be better off paying the money they would have paid to credit cards towards their student loans.
Lastly, we can file sequential Chapter 13 bankruptcies to keep the student loan lenders from collecting. If you are being garnished for your student loans and have no way of making payments, a Chapter 13 plan payment will often be lower than the garnishment. While the student loans won’t go away, at least you will have more money in your pocket.
