J is for Joint Debts

Joint debts or co-signors on your debts can cause some additional twists in dealing with the debts. The basic rule is that a bankruptcy will discharge debts owed by the filing party, but not deal with the liability of the co-signor.

If the joint debt is owed by a husband and wife, we will normally try to have them file together. This would take care of both people liable on the debt. If the joint debt is not with a spouse, the bankruptcy won’t help the joint debtor. Some times, depending on the situation of the joint debtor, we can file separate bankruptcies for both the debtor and the joint debtor.
