Household size is used in many places in the bankruptcy code, but it is never defined. Generally speaking, a larger household size will help a debtor pass the means test in both Chapter 7 and Chapter 13 cases. About all we can say for sure is a spouse living with the debtor and minor children living full-time with the debtor are members of the household.
The devil is always in the details. What about a live-in boyfriend/girlfriend? Adult children? Parent(s) of the debtor? Same-sex partner? Child that a debtor has joint physical custody of? Child that a debtor has visitation rights but not sole physical custody? Child where the debtor is a foster parent? Adults who are in adult foster care where the debtor is the care provider? Polygamous relationships (I’ve never come across this situation, but it is an interesting thought experiment)?
