In a previous post, we had discussed the case of a California married same sex couple Gene Douglas Balas and Carlos Morales filing a joint bankruptcy. The lower court oked their filing, stating that the Defense of Marriage Act is unconstitutional. The United State Trustee (UST) appealed the lower court finding. The UST has now decided to withdraw its appeal. Without the UST’s objection to same sex married couples filing jointly, there shouldn’t be any thing standing in the way of other similar married couples filing bankruptcy jointly.
